2. Subject matter and scope
These Terms govern exclusively the use of the corporate website almatosca.ch, which serves informational purposes and presents the services and products offered under the AlmaTosca project. The Site is not an e-commerce platform: it does not allow account registration, the conclusion of sales contracts, or the placing of orders.
Any use of the B2B platform app.almatosca.ch, reserved for professional operators, is governed by separate general terms communicated upon account activation and is not the subject of this document.
3. Acceptance of Terms
Access to the Site is open and does not require registration. Use of the Site implies that the user has read and accepted these Terms. If the user does not intend to accept them, they are invited to refrain from using the Site.
4. Acceptable use
The user undertakes to use the Site exclusively for lawful purposes and in compliance with these Terms. The following are expressly prohibited:
- using the Site for unlawful, fraudulent, or rights-infringing activities;
- performing automated data extraction (scraping, crawling, data mining) without prior written authorisation from the operators;
- attempting to circumvent security measures, access non-public areas, or compromise the technical integrity of the Site;
- transmitting or conveying illegal, defamatory content, viruses, malware, or harmful code;
- using the Site or its content for competitive purposes, unauthorised benchmarking, or to create derivative services;
- using the contact form for spam, unauthorised commercial prospecting, or mass communications.
The operators reserve the right to take any technical and legal measure deemed appropriate in case of violation of these rules.
5. Intellectual property
All content published on the Site — including texts, images, photographs, videos, illustrations, logos, trademarks, graphics, layout, and software — is protected by Swiss and international laws on copyright, trademarks, and industrial property, and belongs to the respective rights holders (the Site operators, the suppliers of the products represented, or third-party licensors).
Any reproduction, distribution, public communication, modification, or commercial use of the content without prior written authorisation from the respective rights holders is prohibited. Only personal, non-commercial consultation in the course of normal web browsing is permitted.
The "AlmaTosca" trademark, the logotype, and the distinctive elements of the project are jointly used by the operators and may not be reproduced or used by third parties without authorisation.
6. Limitation of liability and availability of the Site
The operators strive to provide accurate and up-to-date information but do not absolutely guarantee the completeness, accuracy, or timeliness of the content published on the Site, in particular with regard to product descriptions, prices possibly indicated for guidance, availabilities, and technical or commercial specifications.
Any prices or product characteristics shown on the Site are purely informative and do not constitute a binding offer within the meaning of Art. 7 CO (Swiss Code of Obligations). The economic conditions of any supplies are agreed on a case-by-case basis with New Target SA outside the Site.
To the extent permitted by law, the operators exclude their liability for damages caused by slight negligence arising from:
- errors, inaccuracies, or omissions in the content published on the Site;
- temporary service interruptions due to maintenance, updates, or force majeure;
- content of third-party websites accessible through links on the Site, over which the operators exercise no control;
- incompatibility of the Site with specific user devices, browsers, or configurations;
- loss of or unauthorised access to data caused by events not attributable to the operators.
Liability for wilful misconduct, gross negligence, personal injury, and any other case in which the limitation of liability is not permitted by applicable Swiss law (in particular Art. 100 CO) remains expressly unaffected.
The Site is provided "as is" and "as available". The operators do not guarantee uninterrupted or error-free operation and reserve the right to temporarily suspend access for scheduled maintenance, updates, security reasons, or force majeure.
7. Processing of personal data and cookies
The processing of personal data collected via the Site is governed by the Privacy Policy, which forms an integral part of these Terms.
The use of cookies and similar technologies is governed by the Cookie Policy and by the consent banner displayed on the first visit.
8. Changes to these Terms
The operators reserve the right to update these Terms at any time, to reflect regulatory, technical, or organisational changes or developments of the Site. The date of the last update is indicated at the top of the document.
Changes take effect upon publication on the Site. Continued use of the Site after publication of the changes constitutes acceptance thereof.
9. Severability and prevailing language
Should one or more clauses of these Terms be declared invalid, illegal, or unenforceable by a competent authority, the remaining clauses shall remain fully valid and effective. The invalid clause shall be replaced by an economically and legally equivalent clause, in compliance with the applicable law.
These Terms are drafted in Italian and translated into German, French, and English for purely informational purposes. In case of interpretative discrepancies between the language versions, the Italian version shall prevail.
10. Governing law and jurisdiction
These Terms, as well as any dispute arising from the use of the Site or from their interpretation, are governed exclusively by Swiss law, excluding the rules of private international law and the United Nations Convention on Contracts for the International Sale of Goods (CISG).
The exclusive place of jurisdiction is Chiasso, Canton of Ticino, Switzerland, subject to mandatory provisions of law.
